PARK & PLAYGROUND RULES

PARK RULES

All parks are open from sunrise to sunset.

Pets are allowed in all parks but must be leashed and cleaned up after.

Do not litter. Place all trash in proper waste receptacles.

No unauthorized motor vehicles allowed within the parks.

Smoking, drugs, and alcohol are prohibited within the parks.

Firearms are prohibited within the parks.

The use of projectiles are prohibited within the parks.

Do not remove any plants, shrubbery, trees, rocks, or make any excavation of park property.

PLAYGROUND RULES

All playgrounds and parks are open from sunrise to sunset.

Playground is designed for children 2-12 years of age.

Inspect playground before using. Check for things such as vandalism and hot surfaces.

Adult supervision is recommended.

Do not use the playground if the outside temperature is 32ºF or below.

Pets or animals of any kind are not allowed on the playground.

No barefeet allowed on the playground.

No rollerblades, skateboards, scooters, or bicycles allowed on the playground.

Do not wear a helmet while using the playground. Helmets can get caught on the equipment.

Do not wear clothing with drawstrings. Drawstrings can cause a choking hazard if caught on the equipment. 

OFFICIAL PARK RULES & REGULATIONS

(replaces “Misdemeanors and Other Offenses”)

1. General Park District Powers

The District hereby establishes Park Rules and Regulations governing the use of parks and park property. Any violations of this policy/ordinance may result in a fine in accordance with this policy/ordinance or other penalty as provided by law. The Board of Commissioners of the District may instruct the attorney for the District to seek an injunction from a court of competent jurisdiction against continued violation of these Rules and Regulations.

2. Enforcement

The Village of Streamwood Police shall enforce Park Rules and Regulations in the park and upon park property and is authorized by the District to do so pursuant to an intergovernmental agreement between the District and the Village providing for such enforcement. No person shall resist any police officer, park employee or agent in the discharge of duty or refuse to obey any lawful command by such person in any park or upon park property.

In enforcing the District’s Park Rules and Regulations prescribed by this policy/ordinance, state and local law enforcement officers, officers and employees of the District, including and the Executive Director of the District, shall have the power and authority to order the removal of any person(s) or organization(s) from the District when warranted hereunder. The physical removal of any person(s) shall only be performed by the Streamwood Police and shall be done in accordance with any and all applicable laws and regulations.

3. Destruction

It shall be unlawful for any person, firm or corporation to intentionally damage or destroy any District property, including but not limited to buildings, tables, benches, equipment, facilities, or park property whatsoever, either real or personal.

4. Removal of Natural Resources

It shall be unlawful for any person, firm or corporation to dig or remove any soil, rock, stones, trees, shrubs, or plants or make any excavation of any park or park property except if permitted by the Director or authorized staff.

5. Erection of Structures

It shall be unlawful for any person, firm or corporation to construct or erect any building or structure whatsoever kind, whether permanent or temporary, in any park or upon any park property except if permitted by the Director or authorized staff.

6. Keep to Drives

It shall be unlawful for any person, firm, or corporation to drive any vehicle on any area except the paved park roads, parking lots, or roadways provided for driving or parking, except for police and Park District employees during the performance of their duties.

7. Speed

It shall be unlawful for any person, firm, or corporation to ride or drive a vehicle off the roads or paths in the parks provided for the same, or to drive in excess of 20 miles an hour thereon. The Director or authorized staff may designate faster or slower speeds by posted signs on certain roads.

8. Application of Motor Vehicle Laws

This policy/ordinance hereby adopts and incorporates by reference the Illinois Vehicle Code and any Village of Streamwood ordinances applicable to motor vehicle operation, all as amended from time to time, with reference to the operation of a motor vehicle in District parks.

9. Traffic Control

It shall be unlawful for any person, firm, or corporation to disobey any traffic control sign or device of the District established in conformity with these Park Rules and Regulations, on any park property.

10. Prohibited Vehicles

Snowmobiles, mopeds, mini-bikes, and similar motorized vehicles are prohibited in the parks. It shall be unlawful for any person to ride or operate such a motorized vehicle within any park, subject to what is allowed for individuals with mobility disabilities through the Electronic Personal Assistive Mobility Device Use Policy

(Ordinance 2011-2-1-O).

11. Intoxicating Beverages and Controlled Substances

It shall be unlawful for any person, firm, or corporation to enter, be, or remain in any park or park facility or on any park property under the influence of intoxicating liquor or controlled substances, or for any person to bring within, possess, drink, use, sell, or transfer any intoxicating liquor or controlled substance in any park or park facility or on any park property; provided that intoxicating beverages shall be permitted at Hoosier Grove Barn and may per permitted, from time to time, in other parks or park facilities with the express written permission of the Board and appropriate liquor licensing.

12. Village of Streamwood Ordinances

The Streamwood Police while within the District parks or on District property, may enforce any Village of Streamwood Code or Ordinance against violation thereof, in addition to enforcing any violation of these Park Rules and Regulations.

13. Control of Pets

Pets, including dogs, cats and other domesticated animals kept as pets, may be brought into any park, only when leashed in accordance with Village of Streamwood ordinance(s), licensed as necessary, and controlled by the person bringing such pet into the park. It is expressly prohibited for any pet while on District property, even though on a leash, to enter or be on a playground. Defecation by any pet while on District property shall be immediately and completely removed by the person in control of the pet. No pets shall be allowed in any Park District facility or building unless brought in for a District program or event involving such pet. In such case, the pet much be leashed, licensed and controlled as aforesaid. The provisions of this section shall not apply to service animals in performance of their duties.

14. Hours

It shall be unlawful for any person to be in a public park at other than designated hours for the use of said park as set out in this section. All parks within the Streamwood Park District shall open at sunrise and close at sunset, or at such other times as is determined by the Director or authorized staff.

15. Closed Areas

It shall be unlawful for any person to be in any park declared closed to the public by the Director or authorized staff at any time, or for any interval of time, either entirely or merely to certain uses as the Director or authorized staff shall determine.

16. Picnic Permits

It shall be unlawful for any person, firm, or corporation to hold or sponsor a picnic or other similar event in any District facility without first obtaining a permit therefore from the Director or authorized staff. The Director may approve procedures for the issuance of such permits.

17. Horseback Riding Prohibited

It shall be unlawful for any person to ride or bring horses within the limits of any District park without the permission of the Director or authorized staff.

18. No Dumping

It shall be unlawful for any person, firm, corporation to dump in or on any District property or rolloff box or dumpster any type of rubbish, construction debris, landscape debris, household garbage other than that generated by normal park activities; to discharge onto any District property sump pump effluent; or to empty or drain onto any District property water or other contents of any privately-owned swimming pool.

19. No Swimming

No personal shall swim, wade or bathe at any time in any of the ponds, streams, lakes, or other natural bodies of water in any park or upon District property. Only pools and water park facilities of the District are intended for swimming use and only those areas are designated for such use and regulations as may be determined by the Director in accordance with section 21 hereof.

20. No Ice Skating

No person, shall ice skate, walk, slide, or otherwise go upon the ice on any pond, lake, stream, or other natural body of water in any park. Ice skating will only be allowed in the parks on bodies specifically developed for such use and posted for such use as determined by the Director or authorized staff.

21. Pool and Water Parks

It shall be unlawful for any person to violate or disobey any rule or regulation determined by the Director or authorized staff relating to the proper use of District pools and water park facilities. The Director or authorized staff may make rules and post notice of same regarding the times and manner of use of the pools and water parks of the District, and may prohibit the use of certain activities in all or any part of the pool or water park facilities of the District.

22. Loitering

It shall be unlawful for any person to loiter or linger about any place, room, area of a facility, building or park commonly used for public assemblies after being ordered away by any District employee or agent in charge of such facility, building, or park.

23. No Golfing

It shall be unlawful for any person to play golf or hit or putt golf balls in any park upon any District property.

24. Facility Rules

In addition to the Park Rules and Regulations established in this policy/ordinance and the Behavior Policy of the District, the following rules and regulations shall apply in all park facilities and buildings:

Smoking and all use of tobacco products are prohibited.

Proper attire appropriate to each facility must be worn at all times. Attire with any combination of letters, words, symbols, pictures, slang terms, abbreviations, phonetic spellings or mirror images that have any connotation, in scatological, obscene or lascivious, shall be prohibited in any Park District facility, including, but not limited to, the following:

  • Breasts, genitalia, pubic area, buttocks, or any matter related to sexual or eliminatory functions.
  • Illicit drugs, narcotics, intoxicants, or related paraphernalia; the sale use or purveyance of any such substances; or the physiological state produced by any such substance.
  • Derogatory references to any race, religion, color, deity, gender, sexual orientation, disability or political affiliation. (Amended August 22, 2002, Ordinance 2002-8-1-O)
  • Children under the age of 12 must be supervised at all times.
  • Photo identification shall be required to obtain reduced rates based on residency or age.
  • Prolonged or chronic sleeping is prohibited.
  • Use of offensive, threatening, harassing, or abusive language or gestures is prohibited.
  • Relocation of furniture or equipment without the permission of staff is prohibited.
  • Fighting or abusing District patrons or staff is prohibited.
  • Roller skates, skateboards, or in-line skates are prohibited, except in specifically designated areas.
  • Any item left overnight may be discarded.
  • Proper wristbands must be worn to use specific areas of park facilities.

All patrons shall abide by all posted and verbal warnings given by District staff.

Use of any Visual Recording Devise, in any Protected Area, to produce, reproduce, record, duplicate, store, display or transmit the visual image of another person is prohibited without that person’s consent.

Definitions. For the purposes of this provision:

  • Protected Area and Protected Areas. Any locker room, dressing room bathroom/restroom, lavatory, shower or bathing facilities located in any District facility.
  • Visual Recording Device. Any electronic, mechanical, manual, electric, digital, voltaic, or other devise, instrument or means capable of recording, producing, duplicating, reproducing, storing, copying, transmitting, or displaying any visual image, picture or representation, including but not limited to, any camera, camcorder, or videotaping device; and that capability or feature of any cellular telephone, portable game device or portable music device that enables such cellular telephone, portable game device, or portable music device to record, produce, duplicate, reproduce, store, copy, transmit or display any video, photographic, electronic, digital or other visual image, picture or representation.
  • Any person who violates this section shall be subject to a fine as provided in the Park Rules and Regulations.

25. Violations

a.Fine

Any person violating any clause or provision of any section of this policy/ordinance shall be fined, upon conviction thereof, not less than twenty-five dollars ($25.00) nor more than one thousand dollars ($1,000.00) for each convicted offense.

b. Eviction or Expulsion

Any person violating any clause or provision of any section of this Ordinance may be evicted or expelled from the park system without refund of fees paid by any person empowered to enforce this ordinance as prescribed in section 2 herein.

c. Damage and Restitution

Any person violating any clause or provision of any section of this policy/ordinance and having also caused damage to the buildings, property or equipment of the District shall make restitution in addition to any other fine or penalty imposed. Restitution shall include all expenses required to make the District whole, including but not limited to contractor’s fees, attorney’s fees, and court costs.

26. Field and Facility Usage

The District has adopted a Field and Facility Usage Procedure that is designed to provide field and facility services in an orderly and fair process. No individual or organization shall be entitled to use the District’s fields and facilities in absence of complying with the permit process, meeting all qualifications, paying fees in a timely manner and making reservations as appropriate. Use of a field or facility without compliance with the Field and Facility Usage Procedure is prohibited and shall result in the immediate ejectment from the District of the individual or organization involved. Repeated violation shall result in a six-month expulsion from usage of the District’s fields and facilities. A third violation of this provision shall be brought to the attention of the Director of the Streamwood Park District who shall them make a determination of the length of the expulsion, which shall not be less than six (6) months nor more than one (1) year. Any expulsion of District field and facility usage may be appealed to the Board of Commissioners, when then shall review the facts and any applicable policies and rules to determine whether the expelled individual(s) or organization(s) was in compliance with the applicable policies and rules.
